Question: Can company legally fire w/out properly going through “discpline actions” as required? I plan to sue.

I just started a job 2 months ago. Originally I was hired for weekend receptionist. During my week training, a co-worker (helped me get the job) told me of vacant position within business office. I met with Business Manager and was told of job description. In addition to working Mon-Fri., I was still required to work 2 weekends/month (original schedule). My pay was suppose to increase, that never happened. One day my boss tells me she is thinking of letting me go b/c she thinks I’m not getting the job. The week after that, she gets fired but came back 3 weeks later b/c she is building a case against the company. On her 1st day back, my boss fires me. She says she hears conflicting reports of my performance. When I ask for specifics, she couldn’t give one. Handbook requires verbal/written warning, suspension, written warning, termination. As you can see, none of that happened? I want to sue for unlawful termination & unfair wages plus emotional distress. I am a single parent of infant.

Answer: You are not protected after working there only a few weeks. If you were not getting the job you can certainly be fired. You are not fully vested until you are there 6 months.

You can try to sue, but it will not go anywhere. There is no emotional distress over a job you just started, it is not like you had spent years dedicating yourself to this company. As long as the wages are legal and you agreed to them they are fair.

I hope you ahve some money, no lawyer will take this case without a good retainer.

Question: How can I go about starting my own online DVD renting business?

I have a lot of DVDs (approximately 150) and am interested in starting my own online DVD rental business. I realize that the amount of DVDs that I have, don’t compare with other online rental sites, but I have to start somewhere. I’m on limited income, so I don’t have a lot of money to spend on DVDs all at once; I thought about starting with what I have, and adding to my inventory as I go on with the business. I would also like to know what paperwork/forms that I would need to complete, to start this online business. I am also planning on adding video games to my inventory at some point. Any advice/step by step instructions on how to get this business started, is greatly appreciated. Please be as detailed as possible with your answer. Thanks!

P.S. I’m also interested in getting either a FREE, or extremly cheap web site for the business; what would you recommend?

Question: Can I sell my nature photography? and how/where?

I’ve been trying for the past several years to sell prints (framed and unframed) of my nature photos ( http://acluckhardt.deviantart.com/gallery/ ) but haven’t had much success. I live in a small town and feel like I can’t get my market. I really want to build my business around selling these prints and build up a substantial amount of sales. If you have a minute, please take a look at some of those samples and let me know if such a plan is even possible… where should I sell? Eventhough I don’t have experience with portraits, should I plan to start taking local outdoor portraits? Thanks!

Answer: I went, and took a look at your photos over at devart. Three of them are really good. Old Barn, Gnarled Trees In Lake, and Winter Snow Scene, which is really outstanding. The rest are good as well, but just don’t stand out like the three. Those three show definate artistic talent, which is something you either have, or don’t, but still needs to be encouraged. Regardless of how you proceed otherwise, you definately need to work on creating a larger portfolio of work in order to have the best chance to generate decent sales. I would also suggest spending some time anylizing those three photos, and what makes them stand out, and how you achieved that, in order to be able to develop the talent you have into a style that feels best to you.

Like many other photographers, I too am still working on the best method to make a living by selling prints, licensing, and whatever. There are several avenues to selling online, which are relatively easy, and inexpesive to pursue, and from many discussions with others on this, I would suggest perhaps offering prints through a couple of the more popular, and basically free for you, sales communities available. You should set up a basic(which is free) CafePress store, as there is no downside to doing so.

I would also suggest joining Flickr, and then also offering prints through Zazzle, which is affiliated with them, allows you to set up a basic, though small store for free, and provides the ability to sell high quality, matted, and framed prints for a more profitable price. You should also take the time to create a blog, in one of the communities like LiveJournal, BlogSpot, or MySpace, so that you have a venue to promote yourself, and your stores. Then be willing to devote a lot of time for several months to build up a network of contacts, and develop some recognition.

It won’t happen overnight, but if you want it badly enough you can build up some steady sales, and more importantly have a realistic chance of building recognition. I have been doing these things for a while, and while the money part isn’t there, I am finally getting some notice, and will be having some of my work published in two separate publications later this year, which gives me something solid to show gallery owners in addition to a portfolio, which greatly improves the chance of getting a show.

Question: How to arrange a successful launch party for a new business?

Our company is launching a new business; including Design services, marketing and business training and consultancy (with a difference)
We want to arrange a launch for this.
Any ideas? Planning to hold it in a large local Chinese restaurant, but what should u include in such an event and how do u invite/ensure local businesses attend?

Are there any formats for creating a plan for a launch, similar to a marketing or business plan template.

Answer: There’s no written format for launches but the questions to ask before doing it are the same as with any marketing activity.

What do you want to achieve from this? (Celebration, new clients, press coverage etc)
Who are the best people to invite to ensure you achieve what you want?
What other ways could you achieve the same thing?

Depending on your answers to these questions, you’ll then have the answers to your question about what to do to ensure that the people you want to attend are there and you’ll also know what to give them. For example, if it’s a press event, you need press releases about the company and sample products or case studies.

Be really clear about why you’re doing this. These kinds of events can work out as very expensive parties with no noticeable returns.
